A Study on the Major Legislation of North Korean Construction Industry

North Korea's construction industry is not well known to the outside world about what systems it has and how it operates. The purpose of this study is to analyze the major laws related to the construction industry in North Korea to understand the overall outline of the North Korean construction industry. In addition, this study compares the major systems related to the construction industry of North and South Korea, and seeks the basic direction of the revision of the construction laws related to North Korea for the development of the construction industry in the future. North Korea's construction-related laws include the 「Land Act」 and the 「National Territory Planning Act」, which stipulate the establishment of a general national territory construction plan and the construction of land and roads. There are 「construction laws」 and 「construction supervision laws」 that stipulate the establishment and implementation of the general construction plan, design and construction. 「The Urban Management Act」, which defines post-construction management, urban road, river stream and land management, forms an important framework for the construction-related system in North Korea. There are various project risks in construction projects, including design, construction, completion, and operation. If the construction permit is determined by the policy maker's intention rather than by law, the level of business risk will inevitably increase. In this case, the investor avoids the construction investment, and the client and the contractor will be less likely to predict the progress of the construction business. As North Korea's economy becomes more advanced and its scale expands, it is expected that the construction legislation of North Korea will become clearer and more systematic. Construction business license (registration) system, construction qualification system of construction work, subcontracting contract, payment of construction cost, defect guarantee responsibility, construction guarantee, development and management of construction technical and technical personnel, process management, construction project management, construction dispute adjustment etc, It is expected to introduce and maintain various systems in the construction industry of North Korea.
